GENERAL TERMS OF USE

These general terms of use (the "Terms of Use") apply to the website www.117ruedubac.com accessible from anywhere in the world (the "Website"). The Website is the property of Benda Bili, a simplified joint-stock company with capital of €27,386, registered in the Paris Trade and Companies Register under number 534 652 854, whose registered office is located at 115 rue du Bac in Paris - 75007, France.
The privacy policy (the "Privacy Policy") can be found in article 3 of these Terms of Use. The legal notices appear at the end of these Terms of Use.
By using the Website, the user ("User") accepts these Terms of Use. In the event of refusal, the User is asked not to use the Website.
Benda Bili reserves the right, at its sole discretion and at any time, to modify these Terms of Use. It is the responsibility of the Website User to review them periodically. By continuing to use the Website after any changes have been made, the User accepts the amended Terms of Use.
1. Ownership/title to the rights to the content of the Website
All text, graphics, interfaces, photographs, logos, sounds, illustrations, computer code and other elements (collectively the "Content") appearing on the Website are owned by Benda Bili. Benda Bili grants the User a right to access and use the Website for strictly personal and non-commercial purposes.
No part of the Website or any Content may be copied, reproduced, republished, uploaded, posted, encoded, translated, transmitted or distributed in any way (including by "mirroring") on any other computer, server, website or publication or distribution medium, or for any commercial enterprise whatsoever, without the prior written consent of Benda Bili.
2. Use of the Website
The use of automatic devices to access all or part of the Website is strictly prohibited. The User shall refrain from any measure that would impose an excessive load on the infrastructure of the Website or any attempt to intrude or test system vulnerability.
3. Processing of personal data – Data Privacy Policy
Benda Bili attaches paramount importance to the protection of privacy and personal data ("Data") of Users of the Website.
The purpose of the Privacy Policy is to inform Website Users of the means used by Benda Bili to collect, consult, process and store their Data, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") and French law no. 78/17 of 6 January 1978, as amended ("Data Protection Act").
The data controller, who collects the Data and implements the processing of this Data, is Benda Bili (the “Data Controller”).
Process” or “Processing” means any operation or set of operations applied to the Data, such as collection, recording, organisation, structuring, storage, adaptation or modification, extraction, consultation, use, limitation, erasure or destruction.
Benda Bili may collect the User’s identification data (name, first name, date of birth, email address, telephone number) and navigation data (IP address, browser type, browser language, location data, login date and time.
3.1. Legal basis for the Processing
The legal bases for the Processing of collected Data are as follows:
- Consent: when the User gives their consent, Benda Bili may process their Personal Data for the specific purposes to which the User has consented;
- Legitimate interest: Benda Bili has a legitimate interest when processing the User’s Data for purposes such as improving the User experience or the security of the Website;
- Legal obligation: Benda Bili fulfils a legal obligation whenever processing the User’s Data is necessary to comply with a legal obligation in the country of operation.
3.2. Purposes of the Processing
The purposes of the Processing of collected Data are as follows:
- Communications and advertising: this Processing allows the sending of marketing communications (newsletters, SMS, WhatsApp) and ensures relevant advertising targeting on third-party platforms.
Marketing Data is retained for three (3) years from the date of the User’s last contact. For targeted advertising, this period is set at twelve (12) months from the date of collection, or ceases as soon as consent is withdrawn;
- Optimisation and security: this Processing is dedicated to the continuous improvement of navigation on the Website. It includes content updates, system security, fraud prevention, as well as statistical analysis of audience and traffic.
Navigation data is retained for six (6) months.
Some Data may be retained beyond the retention periods indicated if requested in connection with the discovery and/or prosecution of criminal offences or the provision of such Data to police, administrative or judicial authorities.
3.3. Data Processors and Data Recipients
In certain cases, as described below, the Data collected may be transmitted to third parties, who may process the Data on behalf of Benda Bili (Processors) and/or for their own purposes (Data Recipients). For information purposes, here is a non-exhaustive list of Data Processors and Data Recipients (further information on Data Processors and Data Recipients may be provided upon request [to the Data Protection Officer):
Data Recipients
- Any police, administrative or judicial authority in the context of requisitions concerning, in particular, the fight against fraud;
- La Poésie, simplified joint-stock company, registered in the Paris Trade and Companies Register under number 889 423 414, as part of its collaboration with Benda Bili expressly agrees that Benda Bili transfers certain Data to La Poésie. All processing of this Data by La Poésie is exclusively subject to the privacy policy of La Poésie;
- Stores and points of sale wholly owned by the companies affiliated with Benda Bili (Benda Bili R, Benda Bili Ltd., Benda Bili Inc.). They may have access to all the Data covered by this Privacy Policy.
Data Processors
Benda Bili’s Data Processors may have access to the Data collected for:
- The update and improvement of the contents of the Website and navigation to the Website (Contentsquare, Google, Meta, Segment),
- The maintenance and technical development operations of the Website and internal applications of Benda Bili, including the entities ensure the hosting of the Website, the storage of Data, email service providers, as well as analysis services, tag management, such as Google Analytics and Amazon Web Services,
- Prospecting and communication operations (Batch, Salesforce),
- Ad targeting on third-party platforms (for example, Google, LINE, Pinterest, Snapchat, TikTok, Yahoo Japan), and
- Ensuring the continuity of the User’s experience in the store and point of sale, including the tracking of purchases and orders, returns and refunds (Benda Bili R, Benda Bili Limited, Benda Bili Inc.).
3.4. Transfer of Data outside the European Union
Benda Bili’s subsidiaries - the Data may be transferred to Benda Bili Inc. and Benda Bili Ltd, the US and UK subsidiaries wholly owned by Benda Bili, so that its Users can benefit from the same "customer experience" in Benda Bili stores located in the UK and the USA. These transfers are carried out in accordance with the European Commission’s standard contractual clauses and the adequacy decision in place between the countries of the European Union and the United States ("Data Privacy Framework").
Benda Bili’s Service Providers - the Data may also be transferred to Benda Bili’s service providers, enabling Benda Bili to provide its services to its Users (including hosting providers and technical service providers responsible for managing the Website). These transfers are carried out in accordance with the European Commission’s standard contractual clauses and the adequacy decision in place between the countries of the European Union and the United States.
3.5. Users' Rights to their Data
In accordance with Articles 14 to 22 of the GDPR, any User may exercise the following rights:A right of access to their Data,
- A right to rectify their Data,
- A right to delete their Data,
- A right to object to the processing of their Data,
- A right to limit the processing of their Data, and
- A right to the portability of their Data.
If Benda Bili detects a breach of Data likely to result in a high risk for the rights and freedoms of Users, it undertakes to inform them as soon as possible as well as the competent supervisory authority (notably the CNIL for France).
Any request to unsubscribe may be made to the Data Protection Officer. The User may exercise all their rights by email or by simple letter - Benda Bili, 115 rue du Bac – 75007 Paris, France.
Benda Bili may ask the User to attach certain information to their request (copy of an identity card, passport or other legally recognised identification document) for identification purposes in order to process their request and protect themselves against fraudulent requests from third parties. In the absence of a response or if the response is considered unsatisfactory, the User may refer the matter to the supervisory authority of their country of residence (in particular, for France, the CNIL: https://www.cnil.fr/).
3.6. Data security measures
As the Data Controller, Benda Bili undertakes to take all necessary precautions in order to preserve the security and confidentiality of the Data and, in particular, to prevent it from being altered, distorted or accessed by unauthorized third parties.
4. Warranty disclaimers and limitation of liability
Benda Bili does not warrant that the Website will be error-free or available without interruption. The Website and its Content are provided ‘as is’ and ‘subject to availability’. Benda Bili accepts no liability for the acts, omissions or conduct of third parties in connection with or associated with the User’s use of the Website. The User remains solely responsible for their use of the Website. The User’s sole remedy is to cease using the Website.
The above warranty disclaimers apply to all damages, losses or harm. To the extent permitted by law, Benda Bili cannot be held liable for indirect damages, including lost profits.
5. Applicable law / conflict resolution
Any dispute related to the use of the Website shall be governed by French law. The competent court shall be that of the Paris Court of Appeal, France. In the event of a dispute, an amicable resolution will be sought before any legal action is taken.
